THE GENERAL TERMS & CONDITIONS OF SALE

1. ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS OF SALE

Any order or service subscribed to from DIMSPEED by a consumer or a professional implies unconditional acceptance of these general terms and conditions of sale. These general terms and conditions are the only ones applicable and replace all other terms unless a prior, express, and written derogation has been granted. The consumer acknowledges being fully informed that their agreement to these terms does not require a handwritten signature of this document, as long as the consumer wishes to order online the products offered on the website shop.
DIMSPEED reserves the right to modify these general terms and conditions of sale at any time. The consumer has the option to save these terms, with the understanding that this responsibility lies solely with them. All information is presented in French.
The consumer declares having full legal capacity to commit under these general terms and conditions.

2. PRICES

Prices published by DIMSPEED are in Euros and include all taxes. They do not include shipping costs, which are calculated based on weight, volume, and delivery destination.
Prices may be changed at any time without prior notice due to currency fluctuations or supplier increases. No order will be validated if a price change occurs without the consumer being informed and agreeing to the new pricing.
For products sold outside mainland France, additional shipping fees may be requested even after payment or after order validation by DIMSPEED.

3. ORDER VALIDATION AND ELECTRONIC SIGNATURE

The choice to purchase a product or service is the sole responsibility of the consumer without restriction.
The consumer’s signature on a quote or order is a firm and final commitment.
DIMSPEED warns consumers that orders containing incorrect or incomplete information may cause errors in execution for which DIMSPEED cannot be held liable.
DIMSPEED reserves the right to cancel any order containing erroneous elements (price, description, photo, etc.) and will notify the customer as soon as possible of any modification or cancellation.
Orders to suppliers or manufacturers will only be placed after payment is received.

4. ORDER MODIFICATION AND CANCELLATION

After order acceptance, any modification or cancellation request by the consumer can only be considered if received in writing before shipment or service execution. If the seller does not accept the modification or cancellation, any deposits paid will not be refunded.

5. DELIVERY

Products are delivered to the address provided by the consumer.
In case of absence, the consumer or recipient will receive a delivery notice allowing product collection within 15 days. After this period, the package will be automatically returned to DIMSPEED, and re-delivery costs will be charged to the consumer. DIMSPEED reserves the right to charge an indemnity of 50 euros (excluding tax) in addition to shipping fees.
Products travel at the consumer’s risk and expense. Upon delivery, the merchandise must be unpacked in the presence of the carrier, and any damage or missing items must be noted on the delivery slip. A copy must be sent to DIMSPEED.
Claims for non-conformity in quality or nature must be made within eight days of delivery.
Consumers may choose their delivery method, except for products with free delivery.
If a non-insured delivery method is chosen, no compensation can be claimed from DIMSPEED in case of loss or damage.
dimspeed.com cannot be held responsible for delivery delays. Delivery times are provided by carriers and are indicative only. Delays may result from circumstances beyond our control (weather, logistics, exceptional events, etc.).
Therefore, dimspeed.com disclaims all liability for delays, loss, or damage during transport. Responsibility is only engaged in case of proven fault in order handling, excluding carrier-related events.
Consumers are advised to contact the carrier directly in case of delivery issues.
For deliveries to overseas territories (DOM-TOM) and foreign countries, please contact us.

6. CUSTOMS FEES

DIMSPEED cannot be held responsible for customs fees or taxes related to cross-border sales, which remain the sole responsibility of the purchaser.

7. RETURNS

Consumers have a period of fifteen calendar days from receipt to return products at their own expense for a refund. Returns will not be accepted after sixteen calendar days from delivery.
Return requests must be made in advance by email or postal mail to DIMSPEED. Special orders, factory-direct items, or custom-made parts are non-returnable and non-exchangeable.
Products must not have been unsealed to benefit from the right of withdrawal. Only products returned complete, in their original intact packaging and in resaleable condition will be accepted. Damaged products or those showing signs of assembly will not be refunded or exchanged.
Products must be returned to DIMSPEED or the manufacturer with the original invoice. Warranty cards or other documents must not be filled out to preserve the right of withdrawal.
This right is exercised without penalty except for return shipping, banking, and handling fees. Consumers can choose either reimbursement or exchange. In case of exchange, the consumer bears shipping costs and risks, so it is advisable to package well and insure transport.
If products do not meet return conditions, DIMSPEED reserves the right to retain at least 20% of the product price for handling fees or to return the product at the consumer’s expense.

8. RETENTION OF TITLE CLAUSE

All sums paid by the consumer upon ordering are considered deposits.
Invoices are payable before shipment. Products remain the property of DIMSPEED until full payment including related fees.
From delivery until full payment, the consumer irrevocably assumes all risks (loss, theft, damage) and insurance charges.
In case of total or partial non-payment, DIMSPEED reserves the right to repossess products at the consumer’s expense and risk without formalities.

9. PAYMENT

o pay for their order, the consumer has, at their choice, all the payment methods listed on the order form. The consumer guarantees to DIMSPEED that they have any necessary authorizations to use the chosen payment method at the time of validating the order form.
In the case of payment by check or bank transfer, DIMSPEED can only validate the consumer’s order once the bank clearance period has expired. Therefore, the consumer should allow a validation period of 7 to 10 days from the receipt of their check. If no check is received within 7 days, the order will be automatically cancelled. DIMSPEED reserves the right to suspend any order processing and delivery in case of refusal of payment authorization by credit card from accredited institutions or in case of non-payment. Furthermore, DIMSPEED reserves the right to refuse delivery or to honor any order from a consumer who has not fully or partially paid for a previous order or who is involved in an ongoing payment dispute.
DIMSPEED has implemented an order verification procedure to ensure that no one uses another person's banking details without their knowledge. As part of this verification, the consumer will be required to send DIMSPEED a copy of an identity document as well as proof of address. The order will only be validated after receipt and verification of the documents by our services. In case of a risk of non-payment for a transaction, DIMSPEED reserves the right to refuse to proceed with your order.
Penalties equal to the legal interest rate plus five percentage points shall automatically apply to unpaid amounts after a period of eight days following the invoice date or upon notification of payment rejection for any other payment method.

10. WARRANTIES

All products sold by DIMSPEED benefit from the legal warranty against hidden defects, as well as the manufacturer’s warranty, whose scope and duration vary depending on the products and brands. Orders are delivered in the manufacturer’s original packaging; DIMSPEED cannot be held responsible for improper packaging of the products. To benefit from the product warranty, it is imperative to keep the purchase invoice. In any case, DIMSPEED cannot be held responsible if the manufacturer refuses to apply their warranty for the reasons stated.
The prior return of the equipment (at the buyer’s expense and under their responsibility) is therefore mandatory to determine the conditions of application. No returned equipment will be accepted as cash on delivery or reimbursement without prior agreement from us. Products will be returned postage paid.
Excluded from the warranty are the replacement of consumables (discs, pads, battery, etc.), products that have undergone modifications not foreseen or specified by the manufacturer, repairs or maintenance carried out by persons not authorized by DIMSPEED, or faults caused by the consumer, such as use or installation not conforming to the manufacturer’s specifications or use harmful to the proper preservation of the part.
No returns will be accepted without prior authorization from DIMSPEED. The defective product must be returned within seven working days in its original packaging, including the entire product, its accessories, and the original invoice. After this period, the consumer must renew the request with DIMSPEED. Any incomplete, damaged product or product with deteriorated original packaging will neither be accepted nor exchanged under the warranty. All costs and risks related to the return of the product are the consumer’s responsibility.
If the returned product is considered after inspection to be non-defective, compliant with the manufacturer’s specifications, or not eligible under the manufacturer’s warranty, the return shipping costs will be borne solely by the consumer.
In case of damage caused to a person or property due to a defect in the product, only the manufacturer’s liability can be sought by the consumer, based on the information appearing on the product’s packaging.
If our liability is retained following non-performance or poor performance of our contract, the total compensation will not exceed an amount equal to the price of the goods that caused the damage.
The products offered are not subject to any specific contractual warranty, including any guarantee of results regarding the satisfaction of the consumer’s specific needs.

11. RESPONSIBILITIES

DIMSPEED cannot be held responsible for non-performance of the contract in case of stock shortage or product unavailability, force majeure, unforeseen events, total or partial strikes—especially postal services, transport and/or communication means—flood, fire, or any other cause beyond its control.
DIMSPEED shall not be liable for any indirect damages that may arise from the purchase of the products. The total or partial impossibility of using the products, notably due to hardware incompatibility, cannot engage DIMSPEED’s liability nor give rise to any compensation or refund. The products offered in our store are competition-type; modifications to your vehicle or the fabrication of custom parts may be necessary for installation.
DIMSPEED shall incur no liability for any direct or indirect damage resulting from these terms, including loss of business, loss of profit, material, immaterial or bodily harm, or expenses that may arise.
DIMSPEED would like to draw its valued customers’ attention to the fact that the majority of products are not approved by manufacturers or insurers. They are therefore prohibited for road use. Any product approval is normally indicated on its product sheet. Installing these items may void the manufacturer’s warranty and may cause some insurers to refuse coverage for possible claims. It is therefore your responsibility to declare to your insurer any non-original part installed on your vehicle. DIMSPEED declines all liability of any kind concerning the invalidation of a manufacturer’s warranty, mechanical or electronic breakdown, as well as any loss of insurance coverage.
Under no circumstances can DIMSPEED be held liable, on any occasion or in any manner, for such modifications or the use of the modified vehicle aimed at or resulting in making it non-compliant with applicable administrative regulations. The user is responsible for obtaining any necessary approval related to structural changes caused by the modification or the addition of the ordered product or performed service. Furthermore, DIMSPEED’s liability cannot be sought in case of use in competition.

12. SCOPE

If any of these conditions were to be null or declared void, the other clauses would not be affected and would continue to apply.

13. APPLICABLE LAW – JURISDICTION

THESE GENERAL TERMS AND CONDITIONS OF SALE AND ALL SALES CONCLUDED BY DIMSPEED ARE GOVERNED BY FRENCH LAW.
FOR ANY DISPUTES RELATING TO THIS CONTRACT BETWEEN THE SELLER AND THE CONSUMER, THE COURTS OF STRASBOURG (FRANCE) SHALL HAVE EXCLUSIVE JURISDICTION TO RULE.
